4:03 pm

obviously we're very warm today and tomorrow that is just going to be increasing as high pressure continues to build this ridge, this dome of heat. >> that will start sliding towards us here in the bay area. and as that happens, these temperatures will just go up up up the marine layer compresses, which are already really seeing today. and that means that we can heat up very quickly. so as we take a look at this, you can see that we do have an excessive heat warning for inland communities. that's all the areas that you see in the hot pink there. and that goes into effect as we get into 11:00am tomorrow. and then for san francisco, we have a heat advisory in areas that are just facing the bay. here now for san francisco goes through wednesday for the rest. it does go through saturday. so this is a very sustained long heat wave that's going to be happening here. so tomorrow's highs, take a look. it's extreme heat inner east bay. we could see a spot that gets really close to 110 degrees. so now is the time to make sure that you are making plans

today the supreme court ruled u.s. presidents are now legally immune from criminal prosecution. if it's considered an official act. >> and the historic ruling leaves room for prosecution for at actions deemed an official. >> sounds like that could be kind of messy. our dc's raquel martin is live in washington to tell us what it means for former president trump. >> you guys will this historic ruling all but guarantees former president donald trump will not face criminal trial for his role leading up to the january 6 riot before election day. the former president took to social media to celebrate this news, calling it quote, a big win for the constitution and democracy. >> was the most highly anticipated and by some accounts, most consequential ruling of the year in a 6 to 3 decision, the supreme court declared u.s. presidents immune from prosecution for official that republicans are

4:14 pm

applauding the court's decision which will likely shield former president trump from january 6 related charges, at least until after the election on truth. social trump called it a big win for democracy. the court's conservative majority suggested without some immunity, prosecution of ex-president could quickly become routine. the 3 liberal justices sharply disagreed. justice sonia sotomayor writing the decision, quote, makes a mockery of the principal foundational to our constitution that no man is above the law. the ruling does lee president on the hook for non official acts? but george washington university professor paul schiff, berman warns it would be difficult to separate the 2. it's hard to imagine any prosecution of a president that would not involve some intrusion on executive power. love. today's ruling is a loss for our democracy. the biden campaign is now using the ruling as a rally cry to defeat trump in

4:15 pm

november. so much bigger than >> one moment. one issue, this is about the backbone of this country. >> i that was raquel martin reporting for us tonight from washington. but joining us now to help us understand this ruling, we're joined live by associate professor of law margaret russell, with santa clara university. margaret, thank you for doing this. you were saying earlier markers of >> stopping overly dramatic to say reshapes the limits of presidential power. you're. >> it's not being overly dramatic and being very realistic. during the oral argument, justice kavanaugh said i'm not thinking about this case thinking about a rule for the ages. 10, if that's true, then the rule for the ages has expanded presidential power dramatically in an area in which the public should be particularly concerned. that is if there are serious allegations of criminal as in

4:16 pm

the trump case. >> so justice sotomayor, if i can, quote heard, she says she cautions that this makes the president pretty much a king above. >> the law, it is that true. >> it's close to in the sense that. if there were i'm sort of worthy and modest. president who understood what the constitution about presidential duties. then. the biggest fear would really be that there wasn't enough legal protection, the opinion, but the reason why bring this up is that. in order for much presidential power to go forward at the supreme court said essentially you are making a rule like it relating the king immunity is basically saying not just we can't we

4:17 pm

don't have enough evidence to prove a case. that's not just what they're saying about prosecutors. they're saying even if you could prove that acts of your case immunity protects the president under many circ*mstances from liability simply by saying. i've been exercising my or constitutional duties under the constitution. these are official and. >> margaret, bottom line is the january 6 prosecution serious trouble. >> not right and and here's why. i think there was great disappointment at the slowness that the second take this case up for review, which did not have to happen. and then the slowness of issuing the decision. so i think what it means terms of going to the lower court is that, you know, almost certainly there will be no decision made before the

4:18 pm

election. almost certainly. in terms of what has been stripped out of the prosecution's case, there's going to have to be a very the liver. it careful calling. but the district court judge. what almost the question of first impression, which are okay of all these allegations, water official apps and the dissent says that one problem with this decision is that. the president could argue that ordering the assassination of arrival is the core constitutional duty and it's an official at and if that true, then the district court judge, we'll see large parts of the prosecution stripped away. before we we we send you away president biden is expected to speak out about this hour. >> you have any idea what he's likely to say.

4:19 pm

>> i did not know he was going to particularly talk about this given all that's happened with president. but in the last week or so. certainly. he's a constitutional if by that. i mean, president biden has has followed the law in paying attention to the role of congress, the power of congress, not youth, are putting too much power from the other branches and respecting the contours of constitution and its decision. changes the playing i get that he will reassure the public he's not going to do a power grab, even though this decision allows that to happen. >> and i'm margaret russell are already out of time. i could keep asking you a lot of questions. but thank you so much for your appreciate it. thank you. so have a good evening. all right. let's go outside as we get a look at sfo at this hour and kron 4 meteorologist kyla grogan is here talking about and again heat. a lot of heat. yeah.

4:20 pm

unfortunately effects of the heat combined with some offshore wind is that we have fire danger. not surprising considering we've dealt with, of course, already a lot of brush fires the past couple of weeks. >> so we do have a red flag warning. you can see it's for a good portion of northern california. but as we zoom in here and we get a little more specific to the bay area. this does kick in tonight and it does go through wednesday. you can see the >> coastal mountains in the north bay. also the interior hills and the mountains. same story in the east bay. so those are the areas that are most concerned about. >> and then notice in solano and yolo counties. also, it is a good portion of that area as well. so fire danger. we have to talk about this because unfortunately you seen this before use this to cystic before 85% of wildfires are caused by us caused by humans. so this week as we go through our holiday week, of course, fireworks and things happening. a lot of activities have to make good choices and make sure you're being fire safe. now i talked about the wind is component of this. as we put this into motion tonight, we still have onshore wind. but by the overnight, you'll start to see if you look up by atlas peak. if you

4:21 pm

look up by places like calistoga, you start to see that northerly wind rolling and that's where we wake up tomorrow morning with that northerly wind bringing that offshore dry breeze that will drop those humidity levels that combined with the fact that this high pressure is going continue to build as we go not just across tomorrow, but really across the next week. in fact, look out actually starts to combine with some of that high pressure that's been keeping the southern tier so warm over the last week. so we've got high temperatures. we've got low humidity, a little bit of wind and that's the problem. and you can kind of see, as i put this into motion, this is the departure from normal. and we just keep going as we head across the new next couple of days into the weekend, even and we just don't really have a break in sight. so, ladies, i think the thing about this for me is that we haven't had a stretch this long. this gets really dangerous at this time when we've got dry brush, some wind coming our way tomorrow and incredible. and i do mean incredible temperatures in the

4:22 pm

inner east bay in particular, we could see spots that get, you know, 10809 degrees. you're right. it's day after day after day rate. that's the thing. i don't have a break. so it's a little bit of a heavy thing to deliver today. but i think that we just got to be real about it before warrant, right? we pace yourself. that's right. preparations. yeah. make sure you know where to get cool and make sure you're being real careful as first fires concern not making any kind of, you know, mistakes that you wish didn't that advice. thanks coming >> still ahead, slight relief at the pump. we're going to take a look at a gallon gas is going for here in the bay area. also, now costs even more to cross. the golden gate bridge will have details on new tolls which took effect today. for your money. this
